1. What is zoning?

Zoning provides the standards and regulations that apply to land and structures in the Town of Summerville. These standards and regulations help implement the Town's Comprehensive Plan that contains goals, policies and recommendations of how development in the Town is to be achieved. 

The Town has numerous zoning districts. Each one has a list of permitted uses and standards for building setbacks, densities, and heights. Additionally, some areas may have overlay districts that stipulate additional design guidelines, such as in the Downtown Historic District.

2. What if I want to remove a tree?

The Town of Summerville’s Tree Protection Ordinance provides for additional review and approval for removing trees of certain sizes. For more information and to obtain a application for removal of individual trees visit our Tree Ordinance & Tree Removal Permits page.

3. Why did I get selected for Jury Duty?

The selection is a random computer pick. These names are taken from the Berkeley County and Dorchester County voter’s registration list. This list is updated yearly.

4. What if I ignore my jury summons or just forget about it?

The judge can find you in contempt of court if you do not appear or contact the court. The sentence is punishable by a fine and/or imprisonment.

5. What type of payments does the Municipal Court accept?

1. What happens if I missed my court date for a criminal charge?

If you did not appear for court and did not contact the officer prior to court, your case was heard and the judge found you guilty in your absence. A warrant could be issued for Contempt of Court - Failing to Appear. You will need to report to the Town of Summerville Warrant Division at the:

2. What happens if I missed my court date for a traffic ticket?

If you did not appear for court and did not contact the officer prior to court, your case was heard and the judge found you guilty in your absence. You will need to pay the fine within 15 days of your court date or the process to suspend your driver's license will begin.

If your driver's license is suspended for failing to pay a traffic ticket, you will be required to pay the fines at Summerville Municipal Court and a re-instatement fee at the South Carolina Highway Department.

3. Can I reschedule/continue my court date?

If you need to reschedule your court date and it is before your scheduled appearance, you need to contact the officer at 843-875-1650. You may have to leave a message. You may also request a continuance in open court, however, you will need a valid reason to do so. Valid reasons may include the need to get or consult an attorney or to request a jury trial. The presiding judge may continue the court date on your scheduled court date depending on the circumstances of the case.

4. Do I have to be in court today?

If you were given a court date and time, you will need to either: Appear and plea, or ask for a continuance/jury trial, or pay the ticket (if applicable) prior to court. If you do not appear, you are subject to having your driver's license suspended in the case of traffic charges, or having a warrant issued for your arrest in the case of criminal charges.

5. Something unexpected has come up (e.g. illness, car issues, etc.) and I cannot make my court date today. Can you tell the judge/officer or continue my case?

Your case will be heard as scheduled unless you can provide written documentation as to why you could not make your court date as scheduled. This documentation will need to be provided at least 24 hours prior to the date of your trial for judicial review. If you do not receive resolution on your court date, you will need to contact the court at 843-875-2010.

6. Why didn't the judge dismiss my case since the officer was not there?

All cases in Summerville Municipal Court are heard and evaluated on their individual merits. Each element is considered when a judge makes a decision. Other than the judge, no one can say what she/he would do in your particular case.

7. Can I represent myself?

According to state statute, you may represent yourself. You have the right to introduce evidence, examine and cross-examine witnesses, make closing arguments and otherwise present a defense to the charges. You will be held to the same standards as an attorney.

8. My child (age 17 or older) received a ticket for curfew violation, possession of tobacco, or underage drinking. Does he/she need to go to court?

Yes, your child will need to go to court.

9. My child (age 16 or older) received a traffic ticket. Does [s]he need to appear in court?

In most cases, the ticket may be paid without an appearance, however, there are traffic charges that do require an appearance for traffic violations, regardless of age. If you have any questions regarding required appearances for traffic charges, call 843-875-2010.

10. What is the procedure for entering a plea to a criminal charge?

There are 3 possible pleas to a criminal charge: 

• Guilty: In a Guilty plea, you admit you committed the act(s) charged, that the acts are prohibited by law and that you have no legal defense for such acts.
• Not Guilty: In a Not Guilty plea, you deny guilt and the Town must prove the criminal charge against you.
• No Contest: In a No Contest (or nolo contendere) plea, you neither admit guilt nor deny it.

11. What happens at a trial?

Depending on the alleged offense(s), you are entitled to a trial by jury. You are entitled to hear all testimony against you. You have a right to cross-examine any witness who testifies against you, to testify on your own behalf and you hold a Constitutional right not to testify. If you choose not to testify, a refusal cannot and will not be used against you in determining guilt or innocence. However, if you choose to testify, the Town will have the right to cross-examine you.

You may call witnesses to testify on your behalf and have the right to have the court issue subpoenas for witnesses to ensure appearance at trial.

12. Can I plead by phone?

No, you either need to appear or pay the fine prior to your court date.

13. How long is the court session? Will it last longer than an hour?

Summerville Municipal Court schedules its regular court sessions Tuesdays and Thursdays at 9 a.m, and 3 p.m. Depending on the docket and caseload, sessions may last longer than an hour.

14. Can I get a prayer for judgment?

While a prayer for judgment is used in North Carolina, it is not available in South Carolina

15. Can I appear earlier than my trial date and time and speak with the judge?

You must appear on your designated court date and time. Judges do not talk about pending cases without all parties present. You may contact the officer for a continuance after the initial court date if you are unable to appear.

16. Can I pay my ticket and still appear to plead not guilty?

Payment indicates a guilty plea and forfeiture of fine monies. Appearing on your court date gives you a chance to ask for a reduction in fines or plead not guilty.

The program is 26 weeks long as required by state statute.

2. Does the Criminal Domestic Violence (CDV) program cost anything?

Some programs start at $25 per session.

3. What happens if I do/did not show up on the assigned date?

The agency will notify the court that you did not show and terminate you. You will also be subject to a Failure to Comply charge, which carries a fine of $500 and/or 30 days in jail.

4. What happens if I do/did not complete the Criminal Domestic Violence (CDV) program?

The Criminal Domestic Violence (CDV) agency will notify the court that you did not complete your program and terminate you. You will also be subject to a Failure to Comply charge which carries a fine of $500 and/or 30 days in jail.

Municipal Court - Driver’s License Issues

1. What do I do if my driver's license is suspended for failing to pay a traffic ticket?

You will need to pay the amount(s) outstanding with that particular agency. Each agency will give you a form you will need at the South Carolina Highway Department which will require you to pay reinstatement fee(s) to reinstate your license.

2. What is this letter you sent me saying if I don't pay my ticket my license will be suspended?

You received a Non-Resident Violator's Compact Notice for not appearing on your court date. If you choose not to pay the amount(s), we will notify the South Carolina Highway Department on the 16th day following your court date.

Yes, if you are the person who posted the monies for your bond. If someone else posted your bond monies, the fine cannot be deducted.

6. What will happen if I don't pay my fine by the due date?

If you have a traffic charge and do not pay, your driver's license will be suspended until you do. If you have a criminal charge and do not pay, a warrant will be issued for Contempt of Court.

7. Can I just pay the amount on the warrant and not go to jail?

You will need to go to the Town of Summerville’s Warrant Division and have the warrant served at the Summerville Police Department at:

9. Can I pay my fine over the phone?

10. Can I pay my ticket and still appear to plead not guilty?

11. When will I get my bond money back?

Bonds are only released upon order by a judge, dismissal of the charge, or a finding of not guilty. The bond is returned only to the party posting it. Bond refunds follow the Town of Summerville’s refund process and may take up to 30 days.

The person who paid the money will receive the refund.

14. What are court costs?

Court costs are fees and assessments assigned by state statute created by the South Carolina legislature. They are subject to change annually.

20. Why aren't the employees more helpful?

The law prohibits Summerville Municipal Court employees other than the Municipal Judge or Associate Municipal Judge from explaining or interpreting the law. As a result, court employees must refrain from answering many questions asked of them because to do so would constitute legal advice, which court personnel may not provide. Instead, they must refer you to competent legal counsel.

21. Will you call the South Carolina Department of Motor Vehicles (DMV) and tell them I paid my ticket?

Due to the large volume of traffic tickets, Summerville Municipal Court employees do not make individual calls for this purpose. You will need to take your individual receipt(s) to the Department of Motor Vehicles (DMV).

1. How do I file a complaint about an officer?

3. What attorney should I call to handle my case?

Court employees are not allowed to recommend specific attorneys or law firms. You should contact the South Carolina Bar Association's free attorney referral service at 800-868-2284. You can also check phone listings or ask your friends for recommendations.

4. I can do this in another court. Why can't I do it here?

While Summerville Municipal Court is a part of South Carolina's unified court system. The court is subject to all laws, regulations, and directives from the South Carolina Judicial Department, South Carolina Court Administration, and State Codes of Law. These laws provide parameters and guidelines. Individual courts (municipal and magistrate) have the ability to design court-specific business processes.

If the relative has an attorney, you may contact him or her. Court staff members may provide public information, such as upcoming court dates and how to post bond.

15. What victim services are available?

Victim services for Municipal Court cases are available through the Summerville Police Department by calling 843-873-1262 or 843-871-2463. You may also call the First Circuit Solicitor's Office at 843-871-2460 for state level cases that occurred in Dorchester County. You may also call the Ninth Circuit Solicitor's Office at 843-719-4529 or 843-958-1900 for state level cases that occurred in Berkeley or Charleston County.

The victim advocate can explain the judicial system, act as a link between the prosecutor and the victim, give current case status information, assist in obtaining orders of protection, make referrals (counseling, food, shelter, etc.), and escort victims while they testify or appear at hearings.

16. What have I been charged with?

Court staff members may show you the public record file if it is not confidential or you can look it up online at the First or Ninth Judicial Circuit website.

17. What sentence will I get if I plead guilty?

The judge imposes sentences. Court staff members cannot guess as different facts and laws may apply to each case. However, certain offenses have mandatory sentences meaning a judge cannot order a lesser sentence than is required. Other offenses allow a judge to use discretion. If a charge has a mandatory sentence, the judge will inform you at the time of sentencing.

House arrest is determined by a judicial officer. It may be as a condition of release on bond or it can be a sentence versus jail time by a presiding judge.

Once the amount has been paid in full, you can be released from jail. If it does not have an amount, you will be brought before a municipal judge at the courthouse.

2. What happens if I go to jail?

If you are taken to jail before 9 a.m, you will see a judicial officer, barring exigent circumstances.

3. What is a surety bond?

A surety bond can come from a bondsman, a property with clear title, and/or friends or relatives who will make sure you will appear for court.

You sign a bond form saying you will appear for court and follow any and all conditions until your court date.

1. What is a restraining order?

A restraining order is a commonly-used term for an order of protection or an injunction for harassment.

2. Where can I get a restraining order?

You will need to see a magistrate for a restraining order. To view a list of magistrates, visit the South Carolina Judicial Department website.

3. What is an order of protection?

An order used for protection when there is a family relationship between the defendant and the victim. The victim must state how an act of domestic violence was threatened or committed against the victim.

4. Where can I get an order of protection?

You will need to see a magistrate for an order of protection. To find a magistrate listing, visit the South Carolina Judicial Department website.

5. What is harassment?

Harassment must involve a series of acts that can spread over a long or short period of time, usually within the last year. The acts must show a continuity of purpose directed at a specific person, seriously alarming, annoying, or harassing the victim without serving a legitimate purpose, which would cause a reasonable person to suffer substantial emotional distress.

Due to staffing and liability considerations, we do not conduct records checks. You can call the Summerville Police Department Records Division at 843-871-2463 or check the Public Index Online.

Summerville Municipal Court employees are not authorized to provide this information. You need to check with local law enforcement.

3. What do I do if I have an outstanding warrant on me?

4. How can I get this warrant off my record?

If you were found not guilty or the case was dismissed or nolle prossed, the court date was on or after June 2, 2010 and it was in Summerville Municipal Court, we will automatically expunge it according to state statute.

If you were found not guilty or the case was dismissed or nolle prossed, the court date was on or before June 1, 2010 and it was in Summerville Municipal Court, you will need to submit a request and a completed Expungement Order.

If you were found guilty, but have not had any further convictions for 3 years, you can get more information from the State Solicitor's Office.

5. Can I see my expunged file?

Once a record is expunged, all information about that record is destroyed (in the case of physical records) or deleted (in the case of digital records).

6. Can I see my sealed file?

Summerville Municipal Court employees are not authorized to provide sealed/expunged records to the public. You must submit a completed Request for Records Form.

7. This isn't supposed to be on my criminal record. Why is it showing up?

Summerville Municipal Court employees can only review daily business processes for any irregularities. You should direct questions about identity theft or a known person using your personal information to law enforcement or you should seek advice and assistance from legal counsel.

Residency is determined based off of annexation into the town of Summerville, meaning you pay your taxes to the Town of Summerville. It is possible to have a Summerville address and not live in Summerville municipal limits. In this case, you are considered a non-resident. 3. What do I need to register?

In order to register for any sports program you will need to provide the following documentation:

• Health Insurance Card
• Birth Certificate
• Proof of Residency (If town resident)

1. What is annexation?

Annexation is the process of bringing parcels of land from unincorporated areas of the county into the service area and jurisdiction of a town. It does not affect ownership of your property, but often provides additional public services.

3. Are there any additional costs to being in the Town limits?

While residing or doing business in the Town of Summerville may have some costs, these costs may be offset, in part, by the elimination of county and/or special purpose or private service fees, as well as lower in-town rates. Our Planning and Economic Development Department can provide you a cost comparison at your request.

5. Is it possible for my entire neighborhood to annex into the Town?

Yes. If multiple property owners are interested in incorporating into the Town of Summerville, SC State Law Title 5, “Municipal Corporations,” offers three different methods for requesting annexation:

• Petition of 100% of property owners
• Petition of 75% of property owners having title to 75% of total assessed value of property in an area to be annexed
• Petition of 25% of qualified electors in area to be annexed for an election

6. Am I eligible for annexation?

Annexation eligibility is determined by the location of property in connection with the existing Town of Summerville limits. Eligibility requirements are governed by SC State Law Title 5, “Municipal Corporations.”

To annex into the Town of Summerville, property must be:

1. Contiguous or “touching” the Town of Summerville limits

1. What is zoning?

Zoning provides the standards and regulations that apply to land and structures in the Town of Summerville. These standards and regulations help implement the Town's Comprehensive Plan that contains goals, policies and recommendations of how development in the Town is to be achieved. 

The Town has numerous zoning districts. Each one has a list of permitted uses and standards for building setbacks, densities, and heights. Additionally, some areas may have overlay districts that stipulate additional design guidelines, such as in the Downtown Historic District.

2. How do I find out if my property is located in unincorporated Dorchester, Charleston or Berkeley County or within the Town of Summerville? Why is that important?

Each county and municipality has different rules for developing property, establishing a business license, etc. Therefore, it is very important to determine which jurisdiction your property is located in. The Town of Summerville’s regulations apply only to those properties located within the Town of Summerville’s limits. The Town has an Online Property Lookup Tool available here which allows users to search for a property by TMS, owner or address and find information on zoning, ownership, town council, and more.  You can also contact the Planning Department to confirm whether your property is located within the Town of Summerville.

3. How do I find the zoning and allowed uses of my property?

You can find the zoning of your property on the Town’s Zoning Map (click here for the Interactive Property Lookup Tool) and referencing the Town’s Unified Development Ordinance or by contacting or visiting the Planning Department and requesting that information. Our staff can look up the zoning for your property with your address or tax map number.

4. I am considering rezoning, or changing the use of my property. What do I need to do?

Prior to filling out and submitting an online application through our Citizenserve portal, it is required that you consult with Planning Department staff and schedule a pre-application meeting.

5. How can I find out the rules for developing or making use of my property?

Regulations for property development within the Town of Summerville is governed by the Town’s Unified Development Ordinance, as well as regulations by other governmental agencies such as FEMA and the U.S. Corps of Engineers. The Planning Department is available to assist you. Contact our staff to speak with a planner about your specific project.

6. Can I split (subdivide) my land?

Whether or not a property is eligible for subdivision requires the analysis of several factors, including the zoning district, road frontage and access, total acreage, as well as a number of other items. Most plat and subdivision plan review is handled by the Town’s Engineering department, in coordination with the Planning Department. Contact our staff to speak with someone about your specific project.

7. What are the building setbacks on my property?

Building setback is the minimum distance that a building can be from your property line. Building setbacks can vary by zoning district, building type (primary vs. accessory), and the nature of the adjacent property. Please contact the Planning Department to confirm your setbacks.

8. What if I need an address?

Addresses are assigned by the Planning Department for each building on a property that is habitable (residential or commercial). These addresses are coordinated with the County and entered into the E911 system for emergency services delivery. Only the Town can assign or change addresses within its boundaries. Please contact us or submit an Address Assignment Application through the Planning, Zoning, and Engineering section of the Citizenserve portal to obtain or change an address. 

9. What if I want to remove a tree?

The Town of Summerville’s Tree Protection Ordinance provides for additional review and approval for removing trees of certain sizes. For more information and to obtain an application for removal of individual trees visit our Tree Ordinance and Tree Removal Permits page.

10. What is the Planning Commission?

The Planning Commission, as provided for by South Carolina law, is a seven member citizen appointed Commission in place for purposes of reviewing rezoning requests, zoning ordinance amendments, the Comprehensive Plan, the Capital Improvements Plan, and other items directed by Town Council for recommendation for approval or denial. Agenda items are initiated by staff, Town Council, and requests from property owners, and coordinated by the Planning Department. Recommendations by the Planning Commission are considered by Town Council for final approval or denial.

11. What is the Design Review Board?

The purpose of the Design Review Board is to ensure the development of commercial corridors within the Town of Summerville that contribute to a sense of place and pride and further strengthen the integrity of Summerville’s historic and best characteristics. New mixed-use development, commercial, and industrial development of all types, multi-family development (excluding townhomes if less than 5 units), and major exterior modifications, are required to go before the Board for review of visual and aesthetic character and site layout.

The Board is granted the authority to determine the appropriateness of the construction of the commercial site in pursuit of achieving that style which is characteristic of the region, and of Summerville in particular. The Board also reviews master sign plans and changeable copy signs for commercial establishments for approval (new and alterations to existing). The process aims to respect the character, integrity, and quality of the built environment of the town, without stifling innovative architecture and/or development.

12. What is the Historic District/Board of Architectural Review?

The Historic District/Board of Architectural Review Board is comprised of seven citizens knowledgeable of historic buildings and architecture. The Board reviews all new construction, major exterior modifications, and/or demolition of buildings within the Town of Summerville’s Downtown Historic District. Over 700 structures are included in the Historic District.

13. What is the Board of Zoning Appeals?

The Board of Zoning Appeals is a five-citizen appointed board that, as provided for by SC State legislation, hears appeals of the Unified Development Ordinance where, due to a hardship or peculiar conditions of a particular property, a variance of the regulations is required, (such as a reduction in building setbacks) may be granted. The Board also hears requests for appeals to the written decision of the Zoning Administrator, if a property owner feels that decision was made in error.

14. How do I know if my project has to go before a Committee, Commission, Board or Town Council as part of the review process?

While, many planning and zoning reviews may be handled administratively by the Town staff, due to state law or local ordinance, some reviews require approval by one or more of the Town’s committees, commissions, boards or Council. The Planning Department staff is available to advise you on the process as it relates to your specific goals. It is recommended that you consult them early in your project, as they will be able to help with ordinance compliance and save you time later.
